Board Licensure Defense

Our attor­neys have rep­re­sent­ed den­tists, doc­tors, phar­ma­cists, nurs­es, and oth­er mem­bers of the health­care pro­fes­sion in the defense of licen­sure cas­es brought by the Attor­ney General’s office on behalf of the Cal­i­for­nia Licens­ing Boards.   The firm has been very suc­cess­ful in its defense of den­tists, doc­tors, and health care providers and has a strong rep­u­ta­tion with the Attor­ney General’s office.

The defense of cas­es on behalf of the firm’s clients brought against them by the Licens­ing Boards of Cal­i­for­nia include, but are not lim­it­ed to, gross neg­li­gence as a result of wrong­ful death, repeat­ed acts of neg­li­gence, and incom­pe­tence aris­ing from the per­for­mance of spe­cif­ic patient pro­ce­dures.  These actions have also includ­ed informed con­sent issues, per­form­ing treat­ment beyond the practitioner’s area of exper­tise, and numer­ous oth­er areas where the Board is attempt­ing to either revoke, sus­pend, or place the practitioner’s license on pro­ba­tion.  Spe­cif­ic exam­ples of the types of cas­es in which our firm has defend­ed den­tists and spe­cial­ists with the Den­tal Board of Cal­i­for­nia include, but is not lim­it­ed to, cas­es involv­ing full mouth recon­struc­tions, fail­ure of implants, sinus per­fo­ra­tions, lin­gual nerve pares­the­sias from low­er wis­dom tooth extrac­tions, wrong­ful death from anes­the­sia, and fail­ing to refer to a spe­cial­ist after per­form­ing treat­ment beyond the area of exper­tise of the prac­ti­tion­er or dis­cov­er­ing a post­op­er­a­tive complication.

Spe­cif­ic cas­es involv­ing med­ical doc­tors, ther­a­pists, and phar­ma­cists include, but are not lim­it­ed to the defense of license from para­ple­gia fol­low­ing surgery, fail­ure to pro­vide prop­er post­op­er­a­tive care, informed con­sent issues, self-med­ica­tion, para­ple­gia fol­low­ing surgery, and stan­dard of care issues involved in the per­for­mance of the surgery.
